1. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles.

2. Scope of Service

We currently sell only The Smart Cookie monthly cookie boxes. Orders are fulfilled and delivered exclusively to designated campus pickup locations.

3. Order Fulfillment, Notifications & Transfer of Responsibility

1. Orders are placed via our website and confirmed by email.
2. Delivery is completed once the product is placed at the designated campus pickup location.
3. Risk of loss and responsibility for retrieval passes to the recipient at the time of delivery.
4. We are not responsible for unclaimed orders or delays caused by incorrect or incomplete contact information provided at the time of ordering.
5. Uncollected orders are not eligible for refunds or replacements, except where covered by our optional "Oops! Student Insurance."
6. By placing an order, you consent to receive communications from us by email and/or SMS related to your order, including order confirmations, delivery updates, and pickup reminders.

4. Marketing & Promotional Communications

By providing your phone number, checking the box to receive text messages, and completing checkout, you consent to receive SMS/text messages from The Smart Cookie (Stingo’s Sweets LLC) about your order, campus pickup details, product updates, and promotional offers. Message and data rates may apply. You may opt out at any time by replying STOP to any message. Consent to receive text messages is not required to make a purchase.

5. Refund & Cancellation Policy

Due to the perishable nature of our products, all sales are final. We do not offer refunds, returns, or exchanges under any circumstances.

6. Allergen Disclaimer

Our current kitchen is not allergen-free. We process tree nuts and other common allergens. While we take cross-contamination very seriously and follow strict safety practices, we cannot guarantee that our products are safe for those with severe allergies. Our goal is to one day craft our allergen-free recipes in a dedicated allergen-free kitchen—so stay tuned as we work toward making that a reality.

7. Intellectual Property Rights

All content, branding, recipes, logos, images, designs, and other intellectual property displayed on this site are the exclusive property of Stingo’s Sweets LLC. Unauthorized reproduction, distribution, or use of any materials without express written consent is prohibited.
